Notre Dame Law School's American Constitution Society (ACS) is hosting Prof. David Sloss of Santa Clara University to discuss his recent book, People v. The Court: The Next Revolution in Constitutional Law. In the book, Sloss presents an indictment of the Supreme Court's constitutional doctrine, dividing constitutional law into structural cases and rights cases. He argues the structural cases ignore the Constitution's division of power between the government and the People, and he argues the rights cases fail to recognize that the Constitution grants the People an affirmative, collective right to exercise control over the government. At the end, Sloss offers a set of proposals, which, if adopted, would serve as the next revolution in constitutional law.
